Content Policy

This Deedmob content policy applies to any information, document, photo, image or other kind of data that you, as a Deedmob user, an organisation or a visitor to the Deedmob website, may upload to the Deedmob website, Deedmob platform or Deedmob app through activities including, but not limited to, user registration, public sharing, posting, uploading, linking, downloading, transferring, viewing, blogging, commenting and chat room, bulletin board and forum participation; or submitting or transmitting content including, but not limited to, graphics, art, software, code, data, text, video, audio, text, opinions and descriptions (hereafter “Materials”).

Scope

This Deedmob content policy is part of the Deedmob terms of use and, where applicable, the Deedmob organisation agreement is integrated and applied to this Deedmob content policy. In case of conflict between the terms of this content policy and the terms of use, the content policy shall take precedence to the extent of such conflict.

Security and privacy

Personal information: Information submitted to Deedmob through forms on the Deedmob website, Deedmob platform and Deedmob app is governed according to the Deedmob privacy notice.

Member account, password and security: Upon setting up a Deedmob account in accordance with the Deedmob terms of use and Deedmob organisation agreement, you are entirely responsible for maintaining the confidentiality of your password and account. Furthermore, you are entirely responsible for any and all activities that occur under your account. You agree to notify Deedmob immediately of any unauthorised use of your account or any other breach of security. Deedmob will not be liable for any loss that you may incur as a result of someone else using your password or account with or without your knowledge. However, you could be held liable for losses incurred by Deedmob or another party due to someone else using your password or account. You may not use anyone else’s account at any time without the permission of the account holder.

No unlawful or prohibited use: You agree that you will not use the Deedmob website, Deedmob platform or Deedmob app for any purpose that is unlawful or prohibited by this Deedmob content policy.

You may not:

· Upload, post, email, transmit or otherwise make available any Materials that are unlawful, harmful, threatening, abusive, harassing, tortuous, defamatory, vulgar, obscene, libellous, invasive of another’s privacy, hateful or racially, ethnically or otherwise objectionable;

· Use the Deedmob website, Deedmob platform or Deedmob app, Materials, Deedmob services or activities to “stalk” or otherwise harass or harm another;

· Impersonate any person or entity, including, but not limited to, a Deedmob official, forum leader, guide or organisation; or falsely state or otherwise misrepresent your affiliation with a person or entity; or collect or store personal data about other users in connection with the prohibited conduct and activities;

· Forge headers or otherwise manipulate identifiers in order to disguise the origin of any content transmitted through the Deedmob website, Deedmob platform or Deedmob app;

· Upload, post, email, transmit or otherwise make available any content that you do not have a right to make available under any law or under contractual or fiduciary relationships (such as inside information, proprietary and confidential information learned or disclosed as part of employment relationships or under nondisclosure agreements);

· Upload, post, email, transmit or otherwise make available any content that infringes any patent, trademark, trade secret, copyright or other proprietary rights (hereafter “rights”) of any party;

· Upload, post, email, transmit or otherwise make available any unsolicited or unauthorised advertising, promotional materials, so-called junk mail, spam, chain letters and pyramid schemes or any other form of solicitation;

· Upload, post, email, transmit or otherwise make available any material that contains software viruses or any other computer code, files or programs designed to interrupt, destroy or limit the functionality of any computer software or hardware or telecommunications equipment;

· Use the Deedmob website, Deedmob platform or Deedmob app in any manner that could damage, disable, overburden or impair any Deedmob server or network connections, disobey any requirements, procedures, policies or regulations of networks connected to the website, platform or app or interfere with any other party’s use and enjoyment of the website, platform or app;

· Attempt to gain unauthorised access to any Deedmob website, Deedmob platform or Deedmob app, other accounts, computer systems or networks connected to any Deedmob servers through hacking, password mining or any other means to obtain or attempt to obtain any Materials or information through any means not intentionally made available through the website, platform or app;

· Violate, intentionally or unintentionally, any applicable local, state, national or international law including, but not limited to, regulations promulgated by the U.S. Securities and Exchange Commission, any rules of any national or other securities exchange and any regulations having the force of law; and/or

Copyright permission: The copyright of all content posted on the Deedmob website, Deedmob platform and Deedmob app is owned by Deedmob B.V. You are not permitted to use any of the content without prior written approval from Deedmob.

Notices and disclosures

Exclusions of warranty: The Materials and Deedmob website, Deedmob platform and Deedmob app are provided by Deedmob and/or its worldwide direct or indirect subsidiaries and affiliates (hereafter “Deedmob”) as a service to its customers.

IN NO EVENT SHALL DEEDMOB OR ITS SUPPLIERS BE LIABLE FOR ANY DAMAGES WHATSOEVER (INCLUDING, WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, BUSINESS INTERRUPTION, LOSS OF INFORMATION) ARISING OUT OF THE USE OF OR INABILITY TO USE THE WEBSITE, PLATFORM OR APP, EVEN IF DEEDMOB HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. BECAUSE SOME JURISDICTIONS PROHIBIT THE EXCLUSION OR LIMITATION OF LIABILITY FOR CONSEQUENTIAL OR INCIDENTAL DAMAGES, THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

Limitation of liability: YOU EXPRESSLY UNDERSTAND AND AGREE THAT DEEDMOB AND ITS LICENSORS SHALL NOT BE LIABLE TO YOU FOR:

IN NO EVENT SHALL DEEDMOB AND/OR ITS RESPECTIVE SUPPLIERS BE LIABLE FOR ANY SPECIAL, INDIRECT OR CONSEQUENTIAL DAMAGES OR ANY DAMAGES WHATSOEVER RESULTING FROM LOSS OF USE, DATA OR PROFITS WHETHER IN AN ACTION OF CONTRACT, NEGLIGENCE OR OTHER TORTIOUS ACTION, ARISING OUT OF OR IN CONNECTION WITH THE USE OR PERFORMANCE OF ANY SOFTWARE, DOCUMENTS, PROVISION OF OR FAILURE TO PROVIDE SERVICES, OR INFORMATION AVAILABLE FROM THE WEBSITE, PLATFORM OR APP.

ANY LOSS OR DAMAGE WHICH MAY BE INCURRED BY YOU, INCLUDING, BUT NOT LIMITED TO, LOSS OR DAMAGE AS A RESULT OF ANY RELIANCE PLACED BY YOU ON THE COMPLETENESS, ACCURACY OR EXISTENCE OF ANY CONTENT, OR ANY CHANGES DEEDMOB MAY MAKE TO THE SERVICES, DOCUMENTS, WEBSITE, PLATFORM OR APP, CONTENT OR FOR ANY PERMANENT OR TEMPORARY CESSATION IN THE PROVISION OF THE WEBSITE, PLATFORM OR APP (OR ANY FEATURES WITHIN THE WEBSITE, PLATFORM OR APP ); OR IF APPLICABLE, YOUR FAILURE TO KEEP YOUR PASSWORD OR ACCOUNT DETAILS SECURE AND CONFIDENTIAL;

THESE LIMITATIONS ON DEEDMOB’S LIABILITY SHALL APPLY WHETHER OR NOT DEEDMOB HAS BEEN ADVISED OF OR SHOULD HAVE BEEN AWARE OF THE POSSIBILITY OF ANY SUCH LOSSES.

Indemnification: You agree to indemnify and hold Deedmob and its officers, agents, employees, partners and licensors harmless from any claim or demand, including reasonable attorney fees, made by any third party due to or arising out of content you submit, post, transmit or otherwise make available through the Deedmob website, Deedmob platform or Deedmob app; through your use of the website, platform or app; through your connection to the website, platform or app; through your violation of this Deedmob content policy or site-specific Deedmob content policy; or through your violation of any rights of another.

Accuracy and completeness: Deedmob does not warrant the accuracy or completeness of the information, text, graphics, links or other items contained within the Deedmob website, Deedmob platform or Deedmob app.

Content-related notices

Deedmob may, in appropriate circumstances, terminate an account holder or subscriber of the Deedmob website, Deedmob platform or Deedmob app if they infringe on this Deedmob content policy, the Deedmob terms of use or the Deedmob organisation agreement.

Non-endorsement: Deedmob does not endorse any Materials or any opinion, recommendation or advice expressed therein, and Deedmob expressly disclaims any and all liability in connection with Materials submissions. Deedmob does not permit copyright infringement activities and infringement of intellectual property rights on the Deedmob website, Deedmob platform or Deedmob app, and Deedmob will remove Materials if properly notified that such submission infringes on another’s intellectual property rights. Deedmob reserves the right to remove Materials at its sole discretion and without prior notice.

Ownership: Unless otherwise agreed, Deedmob does not claim ownership of any Materials submitted, posted, transmitted, made available or displayed by you on or through the Deedmob website, Deedmob platform or Deedmob app. Deedmob is under no obligation to post or use any Materials submitted.
